Nubian Rights Forum, Kenya Human Rights Commission and Kenya National Commission on Human Rights v The Hon. Attorney General and Others [2020] eKLR

This case concerned the validity of the implementation of the National Integrated Identity Management System (NIIMS) in Kenya. The court handed down judgement on 30 January 2020. The judgment can be accessed here.


Amabhungane Centre for Investigative Journalism NPC and Another v Minister of Justice and Correctional Services and Others [2019] ZAGPPHC 384

The case concerns the lawfulness and validity of mass surveillance and the interception of communications by the National Communications Centre in South Africa.  The Gauteng High Court handed down judgement on the case in September 2019, declaring certain sections of the Regulation of Interceptions of Communications and Provision of Communication Related Information Act (RICA) unconstitutional. The judgment can be accessed here.

The case is currently before the Constitutional Court of South Africa to confirm the High Court ruling that certain sections of RICA are unconstitutional and invalid.

Freedom of expression

Federation of African Journalists and Others v The Republic of The Gambia Judgement NO: ECW/CCJ/JUD/04/18

The case was brought by the Federation of African Journalists and individual journalists against The Gambia, arguing that it had failed to protect the rights of citizens in accordance with the international instruments that had it was a signatory to. The judgement can be accessed here.

Media Council of Tanzania and Others v Attorney-General of the United Republic of Tanzania Reference No 2 of 2017

This case concerned a challenge to various provisions of the Media Services Act enacted by the Tanzanian Parliament on the basis that it was an unjustified restriction on the right to freedom of expression.  The judgment can be accessed here.

Zimbabwe Lawyers for Human Rights and The Media Institute of Southern Africa v The Republic of Zimbabwe Case No HC 265/19

This case concerned the validity of directives issued by the Minister in the Presidency which resulted in the shutdown of the internet in Zimbabwe in January 2019. The Court issued a provisional order that the directives issued by the Minister were illegal and therefore without effect. The order can be accessed here.
